3. ONLINE STORE TERMS
3.1 Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
3.2 Age: By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, or that you are the age of majority in your country of residence and you have given us your consent to allow any of your minor dependents to use this site.
3.3 Violating these terms: You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

We are not responsible if information made available on this site is not accurate, complete or current. 6. MODIFICATIONS TO THE SERVICE AND PRICES
6.1 Prices for our products are subject to change without notice.
6.2 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
6.3 We might not be able to accept the order if a product is unexpectedly out of stock, if we cannot authorise the payment, if there has been an error in the price or description of the product, or if we are unable to meet a specified delivery deadline given by you. If we cannot accept your order, we will contact you by the email address you have provided, to inform you of this, and you will not be charged for the order.
7. PRODUCTS
7.1 Product availability: Our products are available exclusively online through the website.
7.2 Product Shipping: Products will be shipped in accordance with our shipping policy. Please note, the risk for the goods transfers to you only when you or a person identified by you takes physical possession of the goods.
7.3 Product Returns: you are entitled to request a return in accordance with our refund policy.
7.4 Product Faults: Under Consumer Rights Act 2015, if a product is damaged or faulty you have the right to a full refund within 30 days of receiving the goods. After this period, you may be entitled to a repair or replacement. Please contact us at info@ettianahome.co.uk to discuss a return or refund for a faulty item. We will then provide you with instructions on how to proceed. Replacement or exchange of faulty goods will be subject to availability of that product at that particular time. Suitable alternatives will be provided if we cannot provide a direct replacement.
7.5 Some of our products are sold individually, and some are sold as a ‘Pre-Styled Home Decor Sets’. A ‘Pre-Styled Home Decor Set’ refers to a group of items, which we have collated to sell as one unit. The price displayed is for the ‘Pre-Styled Home Decor Set’. To find out what is included within a particular ‘Pre-Styled Home Decor Sets’, please see the ‘Pre-Styled Home Decor Sets’ product listing where a full breakdown of items are provided within the description section. The full breakdown of items will also be visible in the shopping basket section when the ‘Pre-Styled Home Decor Set’ has been added to the basket.
7.6 Product variations: As many of our products are handmade and composed of natural materials, they may have slight variations in size/ weights, capacities, dimensions, textures and patterns. These slight variations add to the individual character and beauty of each item. Where artwork is created by hand, it will be described as ‘original’ in the product description and slight variations can be expected.
7.7 Image accuracy: We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that the display on your device will represent every colour accurate. As such, the images that are shown on our website should be used for illustrative purposes only.
7.8 We have provided dimensions for every product, and have made suggestions for the size of shelf that we feel the product and its associated collection would works best in, when considering the products’ scale and size. These suggestions should be used for guidance purposes only. You are responsible for measuring the size of your space and making sure it will suit the products you are purchasing. If you are unsure, please contact us via email info@ettianahome.co.uk and we will be happy to assist you.
7.9 Our brand, Ettiana Home, sells a curated selection of products sourced from a variety of reputable wholesalers and manufacturers. Ettiana Home is a reseller and not the original manufacturer of these items.
7.10 Your right to make changes: If you wish to make a change to the product you have ordered please contact us as soon as possible. Provided you have not received a shipping confirmation email stating that your order is on its way, we may be able to accommodate the changes. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
7.11 We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer.
7.12 All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
7.13 If an item is unexpectedly out of stock, we will try our best to re-source it. If we cannot re-source the particular item, we will provide an alternative as close to the original as possible and email you for confirmation before we dispatch.
7.14 We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
7.15 If you have ordered a ‘Pre-Styled Home Decor Set’, we will aim to send the Set out to you in one box, however sometimes we may need to send the ‘Pre-Styled Home Decor Set’ over multiple boxes. If multiple boxes are required, multiple separate tracking codes will be provided to notify you of this.
8. OWNERSHIP, USE AND INTELLECTUAL PROPERTY RIGHTS
8.1 The Website and all content published on the website including but not limited to any logo, text, images, artwork, photography, graphics, videos, audio or other multimedia content, or other information or material on the Site (‘Content’) are owned by us.
8.2 Intellectual rights means rights such as trade marks, copyright, domain names, product names, product descriptions, product photography, design rights, patents and other intellectual property rights of any kind whether they are registered or unregistered (anywhere in the world). We remain owners of the rights of any intellectual property and free to use them as we see fit. They must not be used, copied, distributed, modified, or reproduced in whole or in part, without the prior written consent of EBL Design Limited. Unauthorised use of our intellectual property is strictly prohibited and may result in legal action.

8.4 If you wish to link to any part of the Website, you must obtain our prior written consent. We reserve the right to withdraw any linking permission we may provide to you without notice.
9. ACCURACY OF BILLING AND ACCOUNT INFORMATION
9.1 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
9.2 We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
9.3 In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
9.4 The payment methods we accept are credit/debit cards, PayPal, Shopify Payments, Visa, Mastercard, American Express, Maestro, Apple Pay, Google Pay, Shop Pay. All payment information is processed securely by third-party providers (e.g., Shopify Payments, PayPal). We do not store sensitive financial details.
10. OPTIONAL TOOLS
10.1 We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

16.3 In no case shall Ettiana Home, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
16.4 Subject to the provisions of clause 16.5, and without prejudice to your statutory rights under the Consumer Rights Act 2015, our total aggregate liability to you for any claim related to any product or service purchased through the Service shall not exceed the amount actually paid for that product or service
16.5 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
16.6 In jurisdictions that do not allow the exclusion or limitation of liability for incidental or consequential damages, our liability shall be limited to the maximum extent permitted by applicable law.
17. FORCE MAJEURE
17.1 Ettiana Home (EBL Design Limited) shall not be liable to the Buyer for any delay in supply or failure to deliver or defect to the goods supplied or delivered that is caused by any event or circumstance beyond its reasonable control (including, but not limited to any accident, act of God, strikes, transport delays, severe weather conditions, pandemic and health crises, government action, wars, terrorist attacks, cyber attacks or technological failures). Where such incidents occur, Ettiana Home (EBL Design Limited) may cancel or suspend any obligations to the buyer without liability.
18. INDEMNIFICATION
18.1 You agree to indemnify, defend and hold harmless Ettiana Home and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
19. SEVERABILITY
19.1 In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

20.2 If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
